Applicant Privacy Notice

Fenix Down Agency, LLC (“Fenix,” “we,” “us,” or “our”) respects the privacy of individuals applying to work with us. This notice explains how we collect, use, and disclose personal information during recruitment for U.S.-based positions.
Information we collect
Depending on the position and your interactions with us, we may collect your name, email address, telephone number, location, résumé, employment and education history, qualifications, portfolio or work samples, availability, and information you provide in applications and interviews. We may also create interview notes and assessments related to your suitability for a position.
We collect this information from you and, where applicable, from references you provide, recruiters, and hiring platforms used in the recruitment process.
Where permitted by law and relevant to the position, we may obtain background-check information from a screening provider, such as verification of employment, education, or criminal history. Before obtaining a report, we will provide required separate disclosures and obtain your written authorization where required. This privacy notice does not authorize a background check.
Where legally permitted, we may invite you to voluntarily provide demographic information through our hiring platform, such as race, ethnicity, or gender. Providing this information is optional, and declining will not negatively affect your application.
How we use information
We use applicant information to review qualifications, communicate with you, arrange and conduct interviews, evaluate work samples, make hiring decisions, maintain recruitment records, and meet applicable legal obligations. If you are hired, relevant information may become part of your employment records and be used for onboarding and employment administration.
We may use background-check information to assess suitability for a position, subject to applicable law. We use voluntary demographic information for lawful equal employment opportunity monitoring and reporting, with access restricted to authorized personnel. We do not use voluntary demographic responses to make individual hiring decisions.
How we disclose information
We disclose applicant information as reasonably needed to personnel involved in hiring and service providers supporting recruitment, communications, and information storage.
We use Justworks to support hiring and employment administration. Relevant information may be provided to or collected through Justworks for these purposes. Justworks’ handling of information is also described in its applicable privacy policies, available at Justworks’ legal information page.
Where a background check is conducted, we may disclose the identifying information needed by the screening provider and receive its findings, subject to applicable notice and authorization requirements.
We may also disclose information to professional advisers or government authorities when necessary to comply with law or establish, exercise, or defend legal rights.
Retention and protection
We retain applicant information for as long as reasonably necessary for recruitment, applicable recordkeeping requirements, and the establishment, exercise, or defense of legal claims. Retention depends on the type of information, the recruitment outcome, and applicable requirements.
We use reasonable administrative and technical safeguards designed to protect applicant information and limit access to people who need it for authorized purposes.
Privacy requests
Depending on applicable law, you may have rights concerning your personal information, such as access, correction, or deletion. To make a request or ask a privacy question, contact info@fenixdown.co. We may need to verify your identity, and some information may need to be retained to meet legal obligations. We will not retaliate against you for exercising rights protected by applicable law.
